How it works in practice

The condo-hotel model is for developers who want to recover part of their capital before a hotel has stabilised. Selling some units to private buyers can repay construction debt or equity early, while the property stays under one operator and one star rating. It suits branded resorts, where buyers will pay for the name and the service, and inland mountain schemes where pre-sales can help fund the build. It is not a route to a residential scheme with a hotel label: the hotel has to keep operating as a single categorised business.

Consider a five-star resort on the coast. A typical structure keeps the lobby, restaurants, spa and back of house with the developer, sells a share of the suites to individual buyers, and places every sold unit in a rental programme run by the hotel operator. Owners receive a share of room revenue and limited personal use; guests see one front desk, one brand standard and one categorisation. Inland, the same structure needs a hotel of at least four stars rather than five, so a mountain lodge in the northern or central region can use it at a lower build specification.

The law sets the principle, not the commercial terms, so the sale documents matter. Check how individual units are titled and registered, what the operator can require of owners, how personal use is limited, and what happens to sold units if the hotel loses its category or changes operator. Lenders will want to see that sold units cannot leave the rental programme. Where the hotel stands on leased state land, establish exactly what right a unit buyer acquires, and for how long, before marketing anything. Take local legal and tax advice on the structure.

Condo sales sit naturally beside the tax incentives for high-category hotels: the same star rating that opens the condo route also earns the property tax reduction in priority tourist locations, and a five-star build gains relief on construction inputs. In the north and centre, a condo-hotel inside a Tourism Development Zone pairs leased state land with a partial exit. Model the hotel as a hotel first, with unit sales as a source of early liquidity, because the operating business has to carry the property for the long term.

This is a summary of the rules as the guide describes them, not tax or legal advice. Confirm current terms with the Ministry of Tourism, the Montenegrin Investment Agency or a local adviser before relying on them.
